FASHIONGO retains the right to modify, shorten, lengthen, or discontinue the Buyer Referral Program at any point, without prior notification, at its sole discretion. FASHIONGO also holds the right to withhold or revoke FASHIONGO Coupons, or to disqualify any Referred Buyer from participating in the Buyer Referral Program, at its discretion. This includes, but is not limited to, actions perceived as fraudulent or any unethical conduct that compromises the program’s fairness or integrity.
By participating in the Buyer Referral Program, you agree to release and hold harmless FASHIONGO, its affiliates, subsidiaries, parent company, directors, officers, employees, agents, and any other entity associated with the program’s marketing (collectively, the “Released Parties”) from any and all claims, losses, or damages arising from or related to the Buyer Referral Program. There are no representations or warranties provided, including statutory warranties and conditions, warranties of merchantability, fitness for a particular purpose, third-party rights, and non-infringement of proprietary rights.
FASHIONGO will not be held liable for any consequential, incidental, or special damages, including lost profits, under any circumstances. FASHIONGO’s maximum aggregate liability related to the Buyer Referral Program will not exceed $100 under any circumstances. Should any legal action be necessary to enforce or interpret the provisions of, or otherwise arises from or relates to, this Buyer Referral Program, the prevailing party will be entitled to reasonable attorney’s fees, costs, and necessary disbursements, in addition to any other applicable relief. Legal action pertaining to the Buyer Referral Program will adhere to the jurisdiction outlined in the program’s terms and conditions.
